WAIVER AND RELEASE OF LIABILITY
PRAM STEPS PARTICIPATION AGREEMENT
This Waiver and Release of Liability (“Agreement”) is executed by the undersigned participant or, in the case of a minor, their parent or legal guardian (“Participant”), in favor of Pram Steps - ABN 66 992 471 754, its affiliates, subsidiaries, officers, directors, employees, agents, volunteers, sponsors, partners, and representatives (collectively, the “Company”). By signing this Agreement, the Participant acknowledges and agrees to the following:
1. ASSUMPTION OF RISK
1.1 The Participant understands that participation in all/any Pram Steps - ABN 66 992 471 754 events, including but not limited to pram walks, community gatherings, social activities, playdates, or any other event (collectively, the “Events”), involves inherent risks.
1.2 These risks may include, but are not limited to, personal injury, property damage, illness (including communicable diseases), adverse weather conditions, accidents, and unforeseen hazards.
1.3 The Participant knowingly and voluntarily assumes all risks associated with their participation, including risks to themselves, their child(ren), and/or their property.
2. RELEASE OF LIABILITY
2.1 The Participant hereby releases, waives, and forever discharges Pram Steps - ABN 66 992 471 754, its officers, directors, employees, agents, affiliates, and partners from any and all liability, claims, demands, or causes of action that arise from participation in the Events.
2.2 This release applies to any claims for personal injury, illness, death, or property damage, regardless of whether caused by the negligence of the Company or otherwise.
3. PHOTO/VIDEO RELEASE
3.1 By participating in any Pram Steps Events, the Participant grants Pram Steps - ABN 66 992 471 754 the irrevocable right to capture, use, publish, and distribute photographs, video recordings, or other media of the Participant and their child(ren). 3.2 These materials may be used for marketing, advertising, promotional purposes, or any other lawful business activities, including but not limited to use on social media platforms, the Company’s website, and printed materials.
3.3 The Participant understands that they will not receive any compensation for the use of such materials. If the Participant does not consent to this provision, they must notify the Company in writing before attending an Event.
4. CHILD SUPERVISION AND RESPONSIBILITY
4.1 The Participant acknowledges that they are solely responsible for the safety, behavior, and supervision of their child(ren) at all times during the Events.
4.2 Pram Steps - ABN 66 992 471 754 does not provide childcare services or assume responsibility for the care of participants’ children.
5. MEDICAL EMERGENCIES
5.1 The Participant agrees that they are responsible for any medical costs incurred due to injuries or illnesses sustained during participation in the Events.
5.2 The Participant authorizes Pram Steps - ABN 66 992 471 754 to seek emergency medical treatment on their behalf or for their child(ren) if required.
5.3 The Participant agrees to provide the Company with an emergency contact name and phone number, which will be used solely for emergencies and in accordance with applicable privacy laws.
5.4 The Participant releases the Company from any liability associated with such medical treatment or emergency communication.
6.DATA COLLECTION AND USE
6.1 The Participant acknowledges and agrees that Pram Steps - ABN 66 992 471 754 may collect, store, and use their contact information, including but not limited to name, phone number, email address, and other personal data, for the purpose of communication, allowing for networking, event coordination, and service improvement.
6.2 The Participant consents to Pram Steps - ABN 66 992 471 754 sharing their contact information and data with third parties, including sponsors, partners, and affiliates, for marketing, promotional, networking and business development purposes.
6.3 The Participant may opt out of marketing communications at any time by contacting Pram Steps - ABN 66 992 471 754 in writing.
7. INDEMNIFICATION
The Participant agrees to indemnify, defend, and hold harmless Pram Steps - ABN 66 992 471 754 from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to their participation or the participation of their child(ren) in the Events.
8.GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which Pram Steps - ABN 66 992 471 754 operates or the Events are held.
9. GLOBAL OPERATIONS
The Participant acknowledges that this Agreement applies globally, and they agree to its terms regardless of the location of any Event or the applicable local regulations, except where such provisions are prohibited by law.
10. ACKNOWLEDGEMENT OF UNDERSTANDING
The Participant affirms that they have read, understood, and voluntarily signed this Agreement, and that by doing so, they agree to waive certain legal rights.
